Internal probe of cartel activity by staff

Genesis was retained by a major fast-moving consumer products (FMCG) company to assist with internal investigations into whether employees were engaged in cartel activity.

Genesis was also retained to assist with subsequent negotiations with the Competition Commission as to an appropriate administrative penalty.

In the latter case, we considered the relevant markets against which turnover was to be assessed, as well as the effect of the employees’ actions and their ability to pay.
