Genesis acts for LPG distributor

Genesis was commissioned to assist a distributor of liquefied petroleum gas (LPG) in cylinders to formulate an application for interim relief against a large LPG wholesaler and a filling station that it supplied for engaging in practices prohibited in terms of the Competition Act, which it felt were preventing it from competing.

The project team produced an independent economic assessment of the alleged conduct and the potential for an adverse finding against the wholesaler.

The assessment concluded that the wholesaler in question had engaged in practices which could be deemed to constitute anti-competitive conduct, resulting in harm to the distributor.

The matter was subsequently settled in favour of the distributor.
