Expert testimony at tribunal on merger

Genesis was retained to provide expert economic analysis and testimony in the merger between Actom, a large manufacturer of electrical machines and rotating devices, and Savcio, a large repairer of similar products.

This required an in-depth understanding of the industry in which the two companies operate in order to define the markets that could have been affected by the merger. This, in turn, created a framework for the assessment of the likely impact on competition.

In addition to an assessment of the competitive impact of the merger, the project team was required to assess the impact of the fact that Savcio and one of its competitors would have some common shareholding as a result of the merger.

The project team’s analysis and testimony at the Competition Tribunal was critical to understanding the rationale for the transaction and the likely effects, as well as conditions to address potential concerns.

The Competition Tribunal ultimately approved the merger with some additional conditions.
