  • Focus Area:

    Manufacturing
    Competition economics
    Competition and Regulatory Economics

  • Area of Expertise:

    Merger analysis and public interest

  • Client:

    Bidpaper Plus

  • Countries:

    South Africa

  • Date:

    2010

  • Project name:

Merger of Bidpaper Plus and Sprint Packaging

Genesis was retained to assist the client’s legal team in responding to competition issues raised by the large merger of Bidpaper Plus and Sprint Packaging, both of which operated in the packaging industry.

In particular, the merger raised vertical issues relating to Sprint’s role in the distribution of packaging to end users on behalf of third parties.

The project team analysed such issues as the level of differentiation between various packaging products as well as the dynamics in bidding markets in order determine the intensity of competition in the industry.

The merger was approved unconditionally by the Competition Tribunal.
