Assistance in accessing university graduate records

Genesis was retained by the legal advisers to Managed Integrity Evaluation, an employee background checking company, to provide economic input in support of an urgent interim relief application against another background checking company that had secured exclusive agreements for access to graduate databases with a number of South African universities .

The case raised complex issues related to when a database may be considered an essential resource and therefore about whether institutions have an obligation to supply data to all industry participants. The project team assisted in formulating the complaint, resulting in a settlement in which access to the database was granted.
