Competition concerns lead to a demerger, five years after implementation

Genesis Analytics assisted in the case of a forestry merger that developed into one of the longestrunning merger trials in South Africa. Genesis was successful in assisting AC Whitcher, a sawmilling company in the Tsitsikamma area, in opposing an intermediate vertical merger, which had initially been approved without conditions by the Commission. Genesis highlighted the potential anti competitive effects of the merger, which resulted in it being approved only subject to stringent supply conditions.
Following further litigation, the merged entity decided to unbundle the transaction.
